{"id":3016,"date":"2018-10-17T23:32:23","date_gmt":"2018-10-18T03:32:23","guid":{"rendered":"http:\/\/www.letterofcredit.biz\/?p=3016"},"modified":"2019-04-06T10:42:19","modified_gmt":"2019-04-06T14:42:19","slug":"types-of-standby-letters-of-credit","status":"publish","type":"post","link":"https:\/\/www.letterofcredit.biz\/index.php\/2018\/10\/17\/types-of-standby-letters-of-credit\/","title":{"rendered":"Types of Standby Letters of Credit"},"content":{"rendered":"<p><strong>What are the Main Types of Stand-by Letters of Credit?<\/strong><\/p>\n<p>In this post after giving the standby letter of credit (SBLC) definition, we will have a look at the role and structure of the SBLC.<\/p>\n<p>Later on we explain types of standby letters of credit such as performance standby letter of credit, advance payment standby letter of credit, bid bond \/ tender bond standby letter of credit, counter standby letter of credit, financial standby letter of credit, insurance standby letter of credit, commercial standby letter of credit.<\/p>\n<p><strong>Definition:<\/strong>\u00a0A standby letter of credit is a bank&#8217;s undertaking of fulfilling the applicant&#8217;s obligations.<\/p>\n<p>A standby letter of credit is issued as a collateral and is therefore not intended to be used as a primary payment method unlike a commercial letter of credit.<\/p>\n<p>Standby letters of credit will be liquefied only if the applicant default of its responsibilities under the underlying contract.<\/p>\n<p>Standby letters of credit can be seen as a mixture of &#8220;commercial letters of credit&#8221; and &#8220;demand guarantees&#8221;. Standby letters of credit have the same structure as the commercial letters of credit, whereas their role is almost identical to the demand guarantees.<\/p>\n<p><strong>Structure:<\/strong>\u00a0According to ISP 98, International Standby Practices, &#8220;A standby is an <span style=\"text-decoration: underline;\">irrevocable<\/span>, <span style=\"text-decoration: underline;\">independent<\/span>, <span style=\"text-decoration: underline;\">documentary<\/span>, and <span style=\"text-decoration: underline;\">binding undertaking<\/span> when issued and need not so state.&#8221;.<\/p>\n<p>These are also the main characteristics of the commercial letters of credit.<\/p>\n<p><strong>Usage:<\/strong>\u00a0The role of a standby letter of credit is that the issuer will \u201cstand by\u201d to perform in the event of the account party\u2019s non-performance or default.<\/p>\n<h4><strong>Types of Standby Letters of Credit:<\/strong><\/h4>\n<ul>\n<li>A \u201c<span style=\"text-decoration: underline;\">Performance Standby<\/span>\u201d supports an obligation to perform other than to pay money, including for the purpose of covering losses arising from a default of the applicant in completion of the underlying transactions.<\/li>\n<li>An \u201c<span style=\"text-decoration: underline;\">Advance Payment Standby<\/span>\u201d supports an obligation to account for an advance payment made by the beneficiary to the applicant.<\/li>\n<li>A \u201c<span style=\"text-decoration: underline;\">Bid Bond\/Tender Bond Standby<\/span>\u201d supports an obligation of the applicant to execute a contract if the applicant is awarded a bid.<\/li>\n<li>A \u201c<span style=\"text-decoration: underline;\">Counter Standby<\/span>\u201d supports the issuance of a separate standby or other undertaking by the beneficiary of the counter standby.<\/li>\n<li>A \u201c<span style=\"text-decoration: underline;\">Financial Standby<\/span>\u201d supports an obligation to pay money, including any instrument evidencing an obligation to repay borrowed money.<\/li>\n<li>A \u201c<span style=\"text-decoration: underline;\">Direct Pay<\/span>\u201d Standby supports payment when due of an underlying payment obligation typically in connection with a financial standby without regard to a default.<\/li>\n<li>An \u201c<span style=\"text-decoration: underline;\">Insurance Standby<\/span>\u201d supports an insurance or reinsurance obligation of the applicant.<\/li>\n<li>A \u201c<span style=\"text-decoration: underline;\">Commercial Standby<\/span>\u201d supports the obligations of an applicant to pay for goods or services in the event of non-payment by other methods.<\/li>\n<\/ul>\n<p><strong>Sources:<\/strong> ISP 98 preface.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>What are the Main Types of Stand-by Letters of Credit?
